Beta Terms for CFO Panorama
Version 1.2 dated 26 October 2026 (supersedes version 1.0 dated 30 September 2026 and version 1.1 dated 22 October 2026). The effective date is stated on publication at https://reporting.finance/legal/ and in the notice under Article 9.1.
1. Parties and subject
1.1 The provider is Hospitality CEE, s.r.o., company ID 19489617, registered office Kaprova 42/14, Staré Město, 110 00 Prague 1, Czech Republic, registered at the Municipal Court in Prague, section C, file 387413 (the "Provider"), which operates the CFO Panorama service at app.reporting.finance (the "Service").
1.2 The customer is each company duly represented when accepting these terms and identified as a contracting party in the acceptance record or signed agreement (the "Customer"). Inclusion in a client group does not itself confer authority to represent a company.
1.3 The Provider lets the Customer use the beta version of the Service to try it out and develop it, and the Customer gives the Provider feedback.
2. Free of charge
2.1 The Service is provided free of charge during the beta. The Customer owes nothing.
2.2 Use of the Service never becomes paid automatically or by the passage of time. Any paid terms will be offered separately by the Provider and apply only if the Customer expressly accepts them.
3. Nature of the beta
3.1 The Service is under development and is provided as is. It may contain errors, may be interrupted, and its features may change or be removed.
3.2 The outputs of the Service are management reports. They do not replace the accounts, the financial statements, an audit, or tax or other professional advice. The Customer checks them against its accounting records before relying on them for decisions. The Customer maintains its original accounts and statutory records outside the Service; the Service is not its statutory accounting archive. This does not affect the Provider’s obligations under the DPA.
3.3 The Provider does not guarantee the availability of the Service or that it will continue to be provided.
4. Customer data and personal data
4.1 Rights in data uploaded by the Customer remain with the Customer or the relevant rights holders. The Customer instructs the Provider to access and use the data as necessary to provide, set up and operate the Service, onboard the Customer, import and map data, diagnose and resolve problems, provide support and maintain security. This instruction includes necessary administrator access by Provider staff and activities under the DPA; within that scope, no separate consent or ticket is required for each access. The Provider does not use the data for unrelated purposes of its own.
4.2 The Provider does not use the Customer's data for comparisons with other customers and does not pool it with other customers' data, including in anonymised form.
4.3 Processing of personal data is governed by the Data Processing Agreement (the “DPA”) concluded together with these terms. In personal-data matters that agreement prevails.
4.4 The Customer uploads only data it is authorised to disclose and have processed. Without the Provider’s prior written agreement, it uploads no special-category personal data, data about criminal convictions and offences, or Czech birth numbers. The DPA governs any agreed exception.
5. Access
5.1 The Customer determines its users and their roles and is responsible for their keeping access credentials and authentication devices secure. It notifies the Provider without undue delay of any suspected misuse of access.
6. Confidentiality
6.1 Each party keeps confidential the other party's non-public information obtained in connection with the Service and uses it only for the purposes of these terms. This does not apply to publicly known information or where disclosure is required by law.
7. Liability
7.1 The Provider is not liable for lost profit, loss of data caused by the Customer, indirect damage, or decisions made on the basis of the Service's outputs.
7.2 The Provider's total liability for harm arising in connection with the Service is limited to CZK 25,000.
7.3 The limitations in this article do not apply to the extent the law does not permit them, in particular for harm caused intentionally or by gross negligence and for harm to the natural rights of a person. This includes protection of a weaker party’s right to compensation under Section 2898 of the Civil Code and mandatory rights under Article 82 GDPR.
8. Term and termination
8.1 These terms apply for an indefinite period. Either party may end them at any time by notice to the other party by e-mail; the Customer may also do so in the application.
8.2 After termination, the Provider allows the Customer 30 days to export data under the DPA. Through an authorised person, the Customer may request earlier permanent deletion and thereby end the remaining Export Period. The Provider deletes without undue delay under the DPA, including its backup rules and lawful exceptions. Before permanent deletion, the Customer obtains any copies it needs; after deletion it has no entitlement to restoration, without prejudice to the Provider’s mandatory obligations.
9. Changes
9.1 The Provider may amend these terms to a reasonable extent because of changes in law, requirements of public authorities, security, technical development of the Service, or changes to its designation or contact details. It notifies the Customer of the new text and a change summary by email and in the Service at least 30 days before effectiveness. The Customer may reject the amendment in writing before it takes effect and terminate without penalty; it may choose immediate termination or three months’ notice, during which the existing terms apply. The Provider will not shorten that period solely because the amendment was rejected; statutory grounds and necessary security restrictions remain unaffected. If the Customer does not reject in time and fresh express acceptance is not required, the amendment applies on the notified date.
9.2 A change under Article 9.1 cannot introduce a charge; Article 2.2 applies to that.
10. Final provisions
10.1 These terms are concluded by electronic acceptance in the application or by signing a written agreement expressly incorporating them. Each Customer is represented by the person or persons authorised to act for it. Where joint representation is required, acceptance is completed only when all necessary declarations concerning the same text are recorded. The Provider retains the record or signed agreement and supplies a copy to the Customer by email.
10.2 These terms are governed by the law of the Czech Republic. Disputes are decided by the courts of the Czech Republic.
10.3 These terms are made in Czech and English. In case of conflict the Czech version prevails.
